Terms
These terms apply to every order placed with SendFM.
1. What you get
A radio stream on our servers with the limits of your plan: listeners at once, quality, space for music and data traffic per month. We do our best to keep your station on air at all times. Our target is 99.5% availability, but that is not a guarantee.
2. Payment and renewal
You pay in advance by bank transfer, using your order reference. We switch your station on as soon as the payment arrives. Ten days before the end of the paid period you get a reminder. If you don't pay, we suspend your station 7 days after the end date. After thirty days of suspension we may delete your station and your music.
3. Cancelling
You can cancel at any time in My station. Your station then stays on until the end of the period you've already paid for. You don't get money back for a period that has already started, unless you withdraw your order (see 4).
4. Cooling-off period (withdrawal)
If you're a consumer, you may withdraw your order within 14 days using the Withdraw order button. If your station was already switched on because you asked for that, we'll refund the amount minus the part for the days your station was on.
5. Limits, data traffic and monitoring
Every minute we measure how many people are listening and how much data traffic your station uses (an estimate based on listeners and quality). At 90% of your listeners or data traffic you get an email. At 100% data traffic your station does what you chose: stop until the 1st of the new month, or keep going for €2.00 per extra TB. More than 3 TB extra per month isn't possible; your station then stops anyway (cost cap). Your station never lets in more listeners than your plan allows.
If your station isn't running, we restart it automatically and email you. This is a best effort, not a guarantee.
5a. Free trial and changing plans
You can try us free once for 7 days, with smaller limits. If you don't pay on time, we suspend your trial station. You can switch to a bigger plan at any time; you pay the difference up to the end of your paid period and the new limits apply as soon as that payment arrives.
6. Your content and music rights
You are responsible for what you broadcast. You arrange the rights for the music you play yourself (in the Netherlands with Buma/Stemra and Sena). You follow the acceptable use rules. If you break them, we may suspend your station; we'll tell you why and you can object.
7. Liability
Our liability is limited to the amount you paid for the last month of your plan, except in cases of intent or gross negligence. We are not liable for missed listeners or income.
8. Personal data
How we handle data is explained in the privacy statement. For your listeners' data we are your processor; the agreements on that are there too.
9. Changes and governing law
We may change these terms; we announce major changes by email one month in advance. These terms are governed by Dutch law.
